1 General AGON PARTNERS PUBLIC

AFFAIRS AG (“AGON PA”) is a ticket sales organization, including a website

2 AGON PA system AGON PA and its suppliers endeavor to provide the Customer with the smoothest and most professional service possible using state-of-the-art technology. To this end, AGON PA uses proven technology as well as proven specialists and suppliers (together: “Suppliers”), applying the necessary care. Nevertheless, AGON PA

2.2 The Customer uses its hardware (including printers), operating software and telecommunications equipment for the use of services at its own risk and expense. The Customer acknowledges that AGON PA and its suppliers/licensors are under no obligation to support or maintain any particular software or to support any particular operating platforms or systems or to maintain their support in the future. To the extent permitted by law, AGON PA disclaims all liability for any damage to the Customer's computer system resulting from the use of the Website or any use of Services. The customer acknowledges without reservation that all services accessed via his account are attributed to him. The customer shall take commercially reasonable precautions to keep the password secret and to prevent its use by unauthorized persons or misuse. The customer shall notify AGON PA (webmaster_at_starticket.ch) immediately if he has reason to believe that his password has been misused.

3 Tickets

3.1 The customer acknowledges that rights and obligations, in particular from the ordering of tickets and/or from the use of other services offered on the website, arise exclusively between the respective organizer and the customer. The contract for the purchase of a ticket is based on these GTC and any additional applicable conditions of the organizer. For concerns and claims of any kind in connection with events themselves, except in relation to the processing of the ticket purchase, the customer must contact the respective organizer directly.

3.2 Tickets are checked electronically at the entrance to the event. We reserve the right to check the authorization of the person presenting the ticket. By purchasing the ticket, the customer acknowledges the safety, age and other access regulations of the organizer. Any regulations imposed by the authorities for attending or holding the event (e.g. contact tracing, Covid certificate, mask requirement, social distancing requirement) also apply, and the customer is responsible for complying with these regulations. In the event of non-compliance, attendance at the event may be refused or excluded. In this case, there is no entitlement to a refund of the ticket price.

3.3 Tickets must be protected from moisture, dirt, mechanical or optical effects and other damage, etc. The barcode must be machine-readable. The barcode must be machine-readable. 3.4 Commercial trade in tickets purchased via the AGON PA system is prohibited and may lead to the loss of the service associated with the ticket and to claims for damages and disgorgement of profits. Persons who violate this provision may be excluded from purchasing tickets.

3.5 If the ticket is not confiscated upon entry, it must be kept until the end of the event and presented on request. Any misuse of tickets is prohibited. The instructions of the event staff must be followed. In the event of non-compliance, the right to claim damages is reserved, in addition to forfeiture of the right to participate. Organizers are entitled to personalize tickets in such a way that only the person printed on the ticket is entitled to enter the respective event. The purchaser must ensure that he/she provides complete and truthful personal details. If several tickets are purchased, this also applies to the other persons who are to be admitted to the respective event.

3.6 Tickets cannot be returned or exchanged, except in the event of an event being canceled in accordance with section 3.7.

3.7 Tickets remain valid if an event is postponed. If an event is canceled without replacement, tickets can be returned up to 30 days after the event date printed on the ticket at the latest, if this is provided for by the organizer.

3.8 Event date. For customers who have purchased their ticket via the website or the call center and paid by credit card/Postcard, a credit note will be issued to the credit card/Postcard. In all other cases, the ticket must be returned to one of the advance booking offices.

3.9 A refund or credit of the purchase price by AGON PA or by an advance booking office will in any case only be made to the extent that the respective regulation of the organizer allows AGON PA or the advance booking offices to do so. The organizer is responsible for refunding the ticket purchase price. A refund or credit exceeding the ticket purchase price is excluded in all cases.

4 Personal data

4.1 The customer acknowledges and agrees that AGON PA and its suppliers may obtain knowledge of personal data in connection with the provision and maintenance of the website and the provision of services. AGON PA will endeavor to ensure confidentiality to the extent required by law and commercially reasonable. Details can be found in the AGON PA policy on the handling of personal data.

5 Information

5.1 AGON PA endeavors to ensure that the information provided on the website is complete, up-to-date and correct. However, AGON PA cannot accept any liability for the accuracy, completeness and up-to-dateness of the information on the website or for transmission errors and accepts no liability for any resulting damage or inconvenience. The customer acknowledges that AGON PA cannot assume any guarantee for the content of linked third-party websites and rejects any liability for this.

6 Rights to the website and ticket system The website and the ticket system are protected by copyright and other intellectual property rights.

6.1 All rights thereto, including rights of ownership and/or use, are held by AGON PA and/or its suppliers/licensors.

7 Amendment of GTCs AGON PA reserves the right to adapt and amend the GTCs at any time. Changes to the

8 Applicable law / place of jurisdiction Swiss law is applicable.

8.1 Any disputes arising in connection with the use of the website or the use of services shall be settled by the courts at the registered office of AGON PA or at the Customer's place of residence, at the discretion of AGON PA.
